AN ACT to amend the executive law, in relation to notification to local
law enforcement of firearm denials
The People of the State of New York, represented in Senate and Assem-
bly, do enact as follows:
1 Section 1. Section 228 of the executive law is amended by adding a new
2 subdivision 2-a to read as follows:
3 2-a. (a) Within twenty-four hours of issuing a denial to a person
4 prohibited from possessing a firearm pursuant to 18 U.S.C. sec. 922(g)
5 or (n), the division shall report the name, date of birth and physical
6 description of such person, and the reason for the denial:
7 i. to the national instant criminal background check system index,
8 denied persons files;
9 ii. to the local law enforcement agency having jurisdiction over the
10 location where the prohibited person sought to acquire the firearm; and
11 iii. to the local prosecutor having jurisdiction over the location
12 wherein the prohibited person sought to acquire the firearm.
13 (b) The local law enforcement agency shall investigate within five
14 business days of receiving such report from the division.
15 § 2. This act shall take effect on the sixtieth day after it shall
16 have become a law.
